General terms and conditions of upup.berlin GmbH for the ezBTS software.
1. Scope & provider
These terms apply to all contracts for the ezBTS software concluded via ezbts.upup.berlin between you and upup.berlin GmbH, Hauptstraße 13 10317 Berlin Deutschland (“we”, “us”). A “consumer” acts for purposes outside their trade or self-employment; an “entrepreneur” acts in the exercise of their trade or profession. Differing terms of the customer do not apply unless we expressly agree in writing.
2. Product & license
ezBTS is an Android app that records behind-the-scenes screen recordings on a DJI RC Plus remote, synchronised with the camera recording. With a purchase you receive a non-exclusive, non-transferable, perpetual license to use ezBTS on one device per license key, including all updates of the current major version (v1). A future major version (v2), e.g. after a breaking change to the DJI Pilot 2 interface, may require a separate paid upgrade; this will be stated openly. You may buy several licenses in one order; each key activates one device.
3. Free trial
We offer an optional 10-day free trial in the app. It requires a one-time registration with your email and your consent to these Terms and to being contacted by us about ezBTS. The trial is limited to one per device and ends automatically after ten days, after which recording is disabled until a license is purchased. No purchase obligation, no auto-renewal, no payment. 4. Conclusion of contract
The product presentation is an invitation to order. By completing payment via PayPal you make a binding offer; the contract is concluded upon our acceptance, at the latest upon delivery of the key. You receive the key and an invoice by email.
5. Prices & payment
The price shown at the time of order applies. Statutory VAT depends on your country and status and is shown at checkout: domestic sales include German VAT; EU consumers may be charged destination VAT (OSS); EU businesses with a valid VAT ID are handled under the reverse charge procedure; non-EU sales are made without German VAT. Payment is via PayPal. For business or larger orders we require a billing address to issue a full invoice.
6. Delivery
The license key is digital content supplied electronically to your email address immediately after successful payment. Please also check your spam folder.
7. Right of withdrawal (consumers)
Consumers have a statutory right of withdrawal; see our withdrawal policy. For digital content delivered immediately, it expires once we begin performance, provided you expressly consented and acknowledged losing the right — given via the checkbox at checkout.
8. Activation & misuse
Each key is bound to the first device on which it is activated. Moving a license requires a reset by us; contact ezbts@upup.berlin. Sharing, publishing, sub-licensing or reselling keys is not permitted. We may disable keys used in breach of these terms.
9. System requirements
ezBTS runs on the DJI RC Plus (Android 10+) with DJI Pilot 2 and relies on the DJI Pilot 2 interface. We make no guarantee of uninterrupted compatibility if DJI changes that interface. Please check the requirements before purchasing.
10. Warranty
The statutory warranty applies. As ezBTS is digital content, §§ 327 ff. BGB apply where you are a consumer.
11. Liability
We are liable without limitation for injury to life, body or health, for intent and gross negligence, under the German Product Liability Act, and within a guarantee given. For slight negligence we are liable only for breach of an essential contractual obligation, limited to the foreseeable, contract-typical damage. Any further liability is excluded. These limitations also apply in favour of our legal representatives and vicarious agents.
12. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods; for consumers, mandatory provisions of their country of residence remain unaffected. For entrepreneurs, the place of jurisdiction is our registered seat. Should individual provisions be invalid, the remainder stays valid. EU ODR platform: ec.europa.eu/consumers/odr; we are not obliged to participate in consumer arbitration.
